EU DATA ACT

1. The purpose of the statement

1.1 This statement is provided in accordance with the EU Data Act (2023/2854) and constitutes pre-contractual information on the data generated, collected and /or stored by:

  • smartwatches, sportswatches, sports bands, smart earbuds and smart rings (altogether "connected products") manufactured under Amazfit brand by Anhui Huami Information Technology Co., Ltd. (Zepp affiliate) and placed on the EU market by its affiliates (hereinafter "we", "us", "our") and
  • Zepp OS, available through dedicated Android and iOS Zepp applications developed by us, designed primarily to collect data from and manage our connected products ("related services").

1.2 This statement covers only raw and pre-processed data accompanied by certain metadata to make sure the data is usable. It applies to the very primary data that is sourced from the use of a connected product or through related services, irrespective if recorded intentionally by the product/service itself, as an indirect result of your use or through your manual input as well as data generated during times of inaction. This statement does not refer to any inferred data resulting from advanced processing of the primary data.

2. Product data and relative services data basic information

2.1 Connected products and related services can generate and/or collect data continuously, (e.g. sensor measurement, usage logs) or event-based (e.g. manual activity records) in real time. Details may vary and depend on the product model and its functionalities, device and technical data, usage and interaction data, and use of a given item.

2.2 In general, connected product data include:

  • Type: sensor-sourced data, location data, diagnostics data, device functioning data, error logs.
  • Format: GPX, TCS, FIT, CSV;
  • Volume: Depends on the use of the connected product and your settings (typically range from kB to GB).

2.3 In general, related services data include:

  • Type of data collected from the connected devices: health metrics originating from the device sensors, location data, device battery level.
  • Type of data generated by related services: app logs, analytics.
  • Volume: Depends on the use of the related services and your settings (typically range from kB to GB).

3. Data storage and retention

3.1 Data will be stored:

  • On-Device: the data stored on the device can be either:

A. overwritten automatically, i.e. newer data overwrites older data (e.g. Location data - as the location changes; diagnostics - when a default and fixed storage size is fully used; device function data - when user changes settings); or

B. Stored as long as the user does not delete it and/or the device data storage space is available.

  • Cloud: We will store your data as long as your account exists unless you delete them manually.

3.2 You may delete on-device data at any time and request deletion of cloud-stored data. However, this might impact your use of the connected product or related services.

4. Your access to the data

4.1 You are entitled to access, retrieve and erase the connected product and relative services data. You can do that through:

  • Mobile Zepp app (upon logging into your Zepp account); or
  • Manual request sent by email to the address: Privacy@zepp.com or DPO@zepp.com;

4.2 Where you decide to use or integrate your data with external service providers (e.g. external fitness tracking applications like Strava) your data will be shared to such third parties upon your explicit consent and in the scope and purpose decided by you.

4.3 In order to request the data share with third parties and - respectively - end such sharing, you can send email to the address: Privacy@zepp.com or DPO@zepp.com.

5. Our use of data

5.1 We expect to use the data generated and collected on connected products and related services primarily to power their functionalities. They will be also used to improve connected products and related services, among others, by developing new products, services and/or features (for that purpose we can share data with our affiliates). We can also use the data to ensure general reliability, ensure proper level of security and prevent misuse.

5.2 We might share your data with cloud infrastructure and database service providers to ensure proper storage and retention of your data.

6. Trade secrets

By default, the data in the connected products and/or generated during the provision of related services neither contains nor constitutes trade secrets.

7. Contract and termination

7.1 Once you launch the connected product and create a Zepp account to fully use the product and benefit from related services, the related contract will last until you delete your Zepp account.

7.2 You can delete your Zepp account at any time, by using in-built features of Zepp mobile app. However, deletion of Zepp account might impact your use of connected product and/or related services (e.g. certain features might not be accessible anymore).

8.1 Please address any questions you might have on your data generated or collected by connected accounts and/or through related services to our email address of: Privacy@zepp.com or DPO@zepp.com.

8.2 You have the right to lodge a complaint with the relevant competent authority designated under Article 37 of the EU Data Act, in the Member State of your habitual residence, place of work or establishment.
